If you were rich and influential how would you play the game?  Would you play "fair and square" or would you 'crib' a little?  Well if you're BHP you'd cheat a lot!  Although I have not one shred of evidence I ask the reader if, in their opinion, this "disappearing invention" trick has not been done before?  What would be the factors which would control whether or not this scam is invoked?

Of course the underground mining and tunnelling industries are the perfect workplace to run this scam.  Some mine sites are not even able to be approached because of the remoteness of the location and the mining company's trespassing rights.  The workforce and the mining professionals are working in a climate of fear because of the threat of "black banning" from the large players in this field.  The worth of the invention can be understood from the revised estimation I produced which is presented on the www.FaceEmplaced.com web-site [mouse-over and left click on the WORTH sub-heading].  I have estimated that the product which would be controlled, by the rights to the intellectual property to this invention, to be worth somewhere in the vicinity of $4 billion to $5 billion per year.  The remainder terms for the patents was be 13 years when the rights were transferred from my ownership and therefore the magnitude of the fraud was about $60 billion (Australian currency).  The theft of the rights to this invention qualifies easily - as it satisfies all three requirements for the "disappearing invention" scam!

Wait till other inventors read this and the penny drops about what happened to their invention.  As I've mentioned previously this is just Standard Operating Procedure - you should have seen the looks on the faces of the officers of IP Australia* at the face-to-face interview!

Evidence supporting this "disappearing invention " theory is the American patent attorney's actions in cancelling two huge tranches of CLAIMS in the application for patent.  CLAIMS are the 'engine room'** of any patent and this American patent attorney nearly cancelled all of the CLAIMS in the patent application!  My presumption as to why he did this was to transfer these claims to another patent application called a Patent of Division.  What is apparent now is that there are TWO patent applications in the system now; the original patent application (minus many claims) and the Patent of Division.
